Terms of Service

Hearth Hosting is a service operated by Rinquist Holdings LLC, an Arizona limited liability company. By using Hearth Hosting, you agree to these terms.
1. Acceptance of Terms
By creating an account or using Hearth Hosting ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Rinquist Holdings LLC ("we," "us," or "our").
2. Description of Service
Hearth Hosting provides server infrastructure hosting for Foundry Virtual Tabletop ("Foundry VTT"). We provide the hosting environment only. Foundry VTT is a separate product owned and operated by Foundry Gaming LLC. To use the Service, you must possess a valid Foundry VTT software license purchased directly from Foundry Gaming LLC at foundryvtt.com.
We do not provide, sell, or sublicense Foundry VTT software. We do not store, access, or retain your Foundry VTT license key. License activation is handled directly between your browser and Foundry Gaming LLC's servers.
3. Eligibility and Age Requirements
You must be at least 13 years of age to use this Service. If you are between 13 and 18 years of age, you must have the consent of a parent or legal guardian. By creating an account, you represent and warrant that you meet these age requirements.
In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete that information immediately. 4. Account Registration
To use the Service, you must register for an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You may only maintain one account per person. Accounts are non-transferable.
5. Service Tiers, Storage, and Billing
Hearth Hosting offers the following service tiers:
- Adventurer (Free): Includes one Foundry VTT instance with 2GB storage. Instances are automatically removed after 30 consecutive days of inactivity. A single advertisement is displayed on the dashboard.
- Legendary ($8/month or $60/year): Includes one Foundry VTT instance with 10GB storage, no inactivity removal, custom subdomain, and no advertisements.
- Mythic ($12/month or $108/year): Includes one Foundry VTT instance with 25GB storage, no inactivity removal, custom subdomain, daily automated backups, one-click world restore, and priority support.
Paid subscriptions are billed on the interval selected at signup (monthly or annual) through Stripe. We reserve the right to change pricing with 30 days notice to active subscribers. Subscriptions automatically renew until cancelled. You may cancel at any time through your dashboard or by contacting support. Cancellation takes effect at the end of the current billing period.
Refund requests are handled on a case-by-case basis. Contact [email protected] within 7 days of a charge if you are dissatisfied with the Service. We will work to resolve the issue fairly. We do not issue refunds for partial billing periods upon cancellation.
6. Storage Limits and Enforcement
Each tier includes a storage allocation as described above. Storage usage is calculated hourly and covers all files within your Foundry VTT instance, including modules, systems, worlds, and uploaded assets.
If your instance approaches or exceeds its storage limit, the following process applies:
- At 80% of your storage limit: You will receive a warning email.
- At 100% of your storage limit: You will receive a notification email. Your instance will continue running. You have 48 hours to reduce your storage usage by removing modules or assets from within Foundry VTT, or by upgrading your plan.
- After 48 hours over your storage limit: We will begin removing your most recently installed modules sequentially until your instance is back within its storage limit. Your world data, characters, and assets uploaded directly to your world will not be removed.
We will send a confirmation email listing any modules removed during automated cleanup. Upgrading your plan immediately stops any pending enforcement action.
7. Acceptable Use
You agree not to use the Service to:
- Host, store, distribute, or transmit any content that is illegal under applicable law
- Host, store, or transmit any content that is sexually explicit, depicts minors in a sexual context, or constitutes child sexual abuse material (CSAM) — violations will be reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement
- Infringe the intellectual property rights of Foundry Gaming LLC or any third party
- Distribute pirated Foundry VTT modules, systems, or content in violation of their respective licenses
- Attempt to gain unauthorized access to other users' instances or our infrastructure
- Use the Service for any commercial purpose other than running your own Foundry VTT campaigns
- Resell or sublicense access to your hosted instance
- Engage in any activity that disrupts, degrades, or interferes with the Service or other users
- Upload or store content that promotes hatred, violence, or discrimination against any person or group
We reserve the right to suspend or terminate accounts that violate these terms without refund. Serious violations including CSAM will be reported to appropriate authorities immediately.
8. Data, Privacy, and Logging
We collect and process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to such processing.
You retain ownership of all campaign data, worlds, and content you create within your Foundry VTT instance. We do not access, claim ownership of, or use your campaign content for any purpose other than providing the Service.
We maintain security and access logs including IP addresses, authentication events, and administrative actions. These logs are used for security monitoring, abuse prevention, and incident response. See our Privacy Policy for details.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime beyond our control. We are not liable for any losses resulting from Service interruptions.
We reserve the right to modify, suspend, or discontinue the Service at any time. In the event of discontinuation, we will provide active subscribers at least 30 days notice and maintain world data export access for that period.
10. DMCA and Copyright
Hearth Hosting respects intellectual property rights and expects users to do the same. We respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
To submit a DMCA takedown notice, contact us at [email protected] with the subject line "DMCA Notice." Your notice must include: identification of the copyrighted work; identification of the infringing material and its location on our Service; your contact information; a statement of good faith belief that the use is unauthorized; and a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
We are in the process of registering a designated DMCA agent with the U.S. Copyright Office.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Rinquist Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of the Service.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify and hold harmless Rinquist Holdings LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any third party rights, or any content you store or transmit through the Service.
14. Dispute Resolution
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
Before initiating any formal legal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
If arbitration is found unenforceable, disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.
15. Changes to Terms
We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
